The UK vape market is facing increasing scrutiny as enforcement activity and industry research highlight the growing scale of illicit nicotine products. For responsible retailers, these developments present a complex compliance landscape of balancing customer demand, regulatory change and the ongoing responsibility to prevent underage sales.

Recent data shows the issue is far from isolated with almost five million illegal vapes have been seized by UK councils in the past three years. According to findings from vape retailer Vape Club, more than 55% of local councils reported seizing thousands of vape products in 2025, with 1.3 million vapes confiscated in that year alone. Some areas are seeing particularly sharp increases in enforcement activity. Bolton Council reported a 467% year-on-year rise in vape seizures, highlighting how rapidly the issue is escalating in certain regions.

For retailers operating responsibly, the presence of illegal products in the market creates both compliance risks and competitive pressures. Illicit products often bypass UK safety regulations and nicotine limits, and they are frequently sold at lower prices than legitimate products.

However, the challenge for retailers goes beyond what is being sold elsewhere. Increasingly, retailers are being directly asked by customers for illicit nicotine products. Research from Philip Morris Limited found that almost nine out of ten convenience retailers report being asked each week if they stock illicit cigarettes or vapes. In the survey of 200 convenience store managers, 68% said they are approached between two and six times per week, while 70% reported being aware of other local retailers selling illicit goods.

This level of customer demand creates real pressure for store teams. Staff are frequently placed in situations where they must refuse requests for illegal or non-compliant products while maintaining positive customer relationships.

At the same time, the regulatory environment around nicotine products continues to evolve. Proposed measures such as the Generational Smoking Ban aim to reduce smoking rates by preventing future generations from legally purchasing tobacco. While widely seen as a public health initiative, some retailers have raised concerns about unintended consequences.

Retailer Dee Sedani has warned that such measures could risk pushing tobacco products further underground, potentially fuelling the illicit market if enforcement does not keep pace.

Whether through illicit supply, increased enforcement or new regulation, one message is becoming clear: compliance within the nicotine category is becoming more complex for retailers to manage.
